American music mogul Sean “Diddy” Combs is fighting back against what his legal team has described as an unjust prison sentence, filing a formal appeal that could potentially set him free or significantly reduce his time behind bars.

The Bad Boy Records founder, who has remained a dominant force in global hip-hop culture for decades, was sentenced to 50 months (over four years) in prison by U.S. District Judge Arun Subramanian in July. Diddy’s legal team is crying foul over what they call a “perversion of justice.” Their main argument? That Judge Subramanian based the harsh 50-month sentence not just on what Diddy was convicted of, but also on allegations the jury had already rejected.

This practice is known as “acquitted conduct” sentencing—a controversial legal approach where judges can consider charges a defendant was found not guilty of when deciding how long they should spend in prison.

“The judge effectively acted as a thirteenth juror,” Combs’ lawyers stated in their appeal, suggesting that the judge substituted his own judgment for that of the jury.

The defence team argues that the sentence is wildly disproportionate to what people typically receive for Mann Act violations, claiming the judge was influenced by the more serious charges that were dismissed by the jury.

What Happens Next?

The appeal has now moved the case to a higher court, where judges will review whether the sentencing process was fair or whether Diddy deserves a reduction—or possibly even immediate release.

In their filing, Diddy’s lawyers made three key requests:
1. Order Diddy’s immediate release
2. Grant a judgment of acquittal (essentially declaring him not guilty)
3. At minimum, vacate the current sentence and send the case back for resentencing
